Rights of Grandparents
The Family Law Act has always allowed grandparents, or indeed anyone who has a concern for a particular child’s care, welfare or development to ask the Court for orders. The position of grandparents, however, has been strengthened in that they are now included in the specific list of people who can institute proceedings in relation to a child. One of the objects of the provisions of the Act relating to children states that children have a right of contact on a regular basis with both their parents, and with other people significant to their care, welfare and development.
