- After a divorce a gift in a Will to a former spouse is revoked.
- Until divorce, a gift in a Will to a spouse is valid.
- A marriage invalidates any existing Will unless the Will is expressed to be in contemplation of that marriage.
- If property is held as a joint tenancy (which is commonly how real estate is held by spouses), changing your Will is not an effective way of ensuring your spouse does not receive the property.
