Parental Responsibility

Under the Family Law Act each parent has ‘parental responsibility’ for the children unless the Court orders otherwise. Parental responsibility is responsibility for making decisions about the child’s long term care, welfare and development.

This imposes a positive obligation on parents to include each other in decisions about major long term decisions in their children’s lives, such as where they will go to school, whether they should undergo particular medical treatment, what extra-curricular activities they should participate in and whether they should participate in religious activities.

If two parents cannot agree, either may make an application for the Court to decide.
